Introduction to the User Agreement:

Our online store welcomes you, Registered under “Commercial Register No. 4030519577 Activity” ), and informs you that you will find below the terms and conditions regulating your use of this store and all legal effects resulting from your use of the store's services via the Internet through this electronic platform, as the use of any person by Zad Gulf Corporation, whether a consumer of the store's service or product or otherwise, this is an approval and acceptance from him and he is fully qualified according to Sharia, system and law for all the articles and provisions of this agreement and it is a confirmation of your commitment to its regulations and what is mentioned therein, and this agreement applies to all types of dealings between the user and the store except for dealings related to personal status and dealings related to issuing deeds related to the dispositions contained in the property. This agreement is considered valid and effective once you approve it and begin registering with Zad Gulf Corporation for Trade in accordance with Article Ten of the Saudi Electronic Transactions System.

Article One - Introduction and Definitions:

The above preamble is an integral part of this Agreement, and below you will find the meanings and definitions of the key terms used in this Agreement:

1- (Store) This term refers to Zad Gulf Trading Establishment, and this definition includes all forms of Zad Gulf Trading Establishment on the Internet, whether it is an electronic application, a website on the Internet, or a commercial store.

2- (User) This term refers to every consumer who purchases the product or service from the store through its electronic platform.

3- (Agreement) This term means the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.

Article Two - User's Legal Capacity:

1- The user acknowledges that he has legal capacity recognized by Sharia and the system to deal with the store, or that he is not less than eighteen years old.

2- The user agrees that if he violates this article, he will bear the consequences of this violation before third parties.

Article Three - The nature of the commitment of Zad Gulf Trading Establishment:

1- Zad Gulf Trading Establishment’s commitment to consumers or users is to provide (the service or product).

2- Zad Gulf Trading Establishment may provide other services such as after-sales services or other related services, depending on the nature and type of (service or product) required by the user.

Article Four - Controls for the use of Zad Gulf Trading Establishment:

1- The user is committed to using the electronic platform of Zad Gulf Trading Establishment in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.

2- When purchasing a service or product from Zad Gulf Trading Establishment, the user undertakes not to use this service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.

Article Five - Accounts and Registration Obligations:

Upon applying to join the membership of Zad Gulf Trading Establishment as a user, you are committed to disclosing specific information and choosing a user name and a secret password to be used when accessing the services of Zad Gulf Trading Establishment. Thus, you have agreed to:

1- You are responsible for maintaining the confidentiality of your account information and password, and you agree to notify Zad Gulf Trading Establishment immediately of any unauthorized use of your account information with Zad Gulf Trading Establishment or any other breach of your confidential information.

2- Zad Gulf Trading Establishment will not be responsible in any way for any loss that may be incurred by you directly or indirectly, morally or materially, as a result of revealing your username or password information.

3- You are committed to using your account or membership with Zad Gulf Trading Establishment yourself, as you are fully responsible for it, and if someone else uses it, this is evidence that you have authorized him to use the store in your name and on your behalf.

4- You agree, when using Zad Al Khaleejiya Trading Establishment, to use it with all seriousness and honesty.

5- You undertake to disclose true, correct, up-to-date, complete and legal information about yourself as required during registration with Zad Gulf Trading Establishment and you undertake to update your data in the event of a change in reality or if necessary.

6- Zad Gulf Trading Establishment is committed to treating your personal information and contact addresses with complete confidentiality.

7- If it becomes clear to Zad Gulf Trading Establishment that you have disclosed information that is false, incorrect, outdated, incomplete, illegal, or in violation of the User Agreement, Zad Gulf Trading Establishment has the right to suspend, freeze, or cancel your membership, store, or account on the platform, without prejudice to the other rights of Zad Gulf Trading Establishment and its legitimate means of recovering its rights and protecting the rest of the users.

8- In the event of non-compliance with any of the above, the management of Zad Gulf Trading Establishment has the right to suspend or cancel your store or membership or block you from accessing the services of Zad Gulf Trading Establishment again.

Article Six - Electronic Communications and Official Means of Communication:

1- The parties to this agreement agree that communication will be via the email registered on the platform or WhatsApp.

2- The user agrees that all agreements, announcements, data and other communications provided to him electronically are equivalent to their written counterparts, and are an independent argument, in meeting the regulatory and legal requirements.

3- The user agrees to the possibility of communicating with him and informing him of any provisions related to this agreement or related to dealing with him by the management of Zad Gulf Trading Establishment broadcasting general messages to all users or to specific users of Zad Gulf Trading Establishment.

Article Seven - Amendments to the User Agreement and Fees:

1- Zad Gulf Trading Establishment may notify you of any amendment to this agreement according to the official means of communication under this agreement, and accordingly your obligations will be doubled or your rights will be diminished according to any amendments that may be made to this agreement.

2- In the event of an objection to any amendment to the User Agreement, Zad Gulf Trading Establishment hopes that you will stop using its services, as your mere access to your account in Zad Gulf Trading Establishment or your use of Zad Gulf Trading Establishment constitutes your acceptance of the amendments and full and complete consent that negates ignorance, and Zad Gulf Trading Establishment accepts discussion of any proposal regarding these provisions.

3- All fees are calculated in Saudi Riyals, and the user must pay all fees due on the platform, in addition to any other expenses added by Zad Gulf Trading Establishment, provided that payment is made through the approved, specified and available means through Zad Gulf Trading Establishment.

4- Zad Gulf Trading Establishment may impose fees on some users, depending on the offers, products or services they request, or the fees or taxes imposed by the state on the nature of the product or service.

5- Zad Gulf Foundation reserves the right to add, increase, reduce or deduct any fees or expenses under the articles, terms and provisions of the User Agreement, for any of the users, regardless of the reason for their registration.

Article Eight - Payment and settlement services for stores in Zad Gulf Trading Establishment:

1- Zad Gulf Trading Establishment provides, through its partners, the payment and settlement system in Zad Gulf Trading Establishment. It can be done entirely online through the payment options available on Zad Gulf Trading Establishment or through any payment method provided by Zad Gulf Trading Establishment from time to time.

2- Zad Gulf Trading Establishment is committed to determining the price of the service or product that it displays in its store according to the recognized market value.

3- Zad Gulf Trading Establishment is committed to providing invoices, receipts and receipts for all amounts and profits generated in its store, and is committed to giving the user an invoice for his purchase of a service or product from Zad Gulf Trading Establishment.

4- Zad Gulf Trading Establishment is committed to providing the generally accepted accounting specifications in its electronic store, in application of the provisions of this agreement, and for the legal, economic, commercial and organizational interests in this organization.

Article Nine - Your Personal Information and Transaction Details Information:

1- The user acknowledges that he grants Zad Gulf Trading Establishment an unlimited, global, permanent, irrevocable, free of charge, and licensed right to use personal or other information or materials provided or supplied to the Zad Gulf Trading Establishment platform or announced on the platform by joining or using it, through the forms designated for communication and registration, or via any electronic message or any of the communication channels available on the platform. This is for the purpose of achieving any of the interests that the platform deems appropriate.

2- The provisions of confidentiality of consumer information are subject to the rules of the “Privacy and Confidentiality Policy” of Zad Gulf Trading Establishment, and to the provisions contained in this agreement related to confidentiality of information.

Article 10 - Intellectual Property:

1- The intellectual property rights of Zad Gulf Trading Establishment are rights owned by Zad Gulf Trading Establishment in full, whether they were owned by them before or after the establishment of this electronic platform.

2- The user or consumer respects the intellectual property rights of Zad Gulf Trading Establishment, which includes Zad Gulf Trading Establishment itself, and the words, logos and other symbols of Zad Gulf Trading Establishment or displayed on Zad Gulf Trading Establishment, as Zad Gulf Trading Establishment, and every right affiliated with Zad Gulf Trading Establishment, are rights owned entirely by the intellectual property of Zad Gulf Trading Establishment.

Article Eleven - Responsibility of Zad Gulf Trading Establishment:

1- Zad Gulf Trading Establishment is committed to conducting its commercial business through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement.

2 Zad Gulf Trading Establishment shall not bear any claims arising from errors or negligence, whether directly or indirectly or incidentally or by the user or by a third party such as shipping companies.

3- Zad Gulf Trading Establishment, its employees, owners and representatives are committed to ensuring that the (product or service) is sound, legitimate and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.

Article Twelve - Confidentiality of Information:

1- Zad Gulf Trading Establishment adopts (tangible, organizational and technical) standards to protect users and prevent unauthorized persons from accessing and storing users’ personal information.

2- You, as a user, acknowledge that the Internet is not a completely secure medium, and the confidentiality of your personal information cannot be guaranteed 100% through Zad Gulf Trading Establishment.

3- Zad Gulf Trading Establishment has no control over the actions of any third party, or others, such as other web pages linked through links to the platform or third parties claiming to represent you and others.

4- You know and agree that Zad Gulf Trading Establishment may use your information that you have provided to it, for the purpose of providing services to you at Zad Gulf Trading Establishment, and to send marketing messages to you, and that the privacy at Zad Gulf Trading Establishment regulates the collection, processing, use and transfer of your personal identity information, and the rules of information confidentiality are subject to the “Privacy and Information Confidentiality Policy” of Zad Gulf Trading Establishment.

Article Thirteen - Restriction of Access or Membership:

Zad Gulf Trading Establishment may suspend or cancel the user’s membership or restrict the user’s access to the platform services at any time, without notice and for any reason, without limitation.

Article Fourteen - Replacement Policy:

1- Without prejudice to the provisions of the contractual and statutory warranty, the consumer has the right to replace the product provided to him by Zad Gulf Trading Establishment within the three days following the date of receipt of the product, and he does not have the right to replace the product after the three days have passed.

2- In order to replace the product, the product must be in good condition and the consumer must not have used the product or benefited from it. Zad Gulf Trading Establishment has the right to inspect the product before replacing it to ensure its safety.

3- The consumer is not entitled to replace the product in the following cases:

* If the product was manufactured based on the consumer’s request or according to specifications specified by him, with the exception of products that have a defect or that do not comply with the specifications specified by the consumer.

* If the product is defective due to poor possession by the consumer.

Article Fifteen - Return Policy:

1- Without prejudice to the provisions of the contractual and statutory warranty, the consumer has the right to terminate the contract and return the product provided to him by Zad Al Khaleejiya Trading Establishment within the three days following the date of receipt of the product, and he is not entitled to that product after the three days have passed.

2- In order to return the product, it must be in good condition and the consumer must not have used the product or benefited from it. Zad Gulf Trading Establishment has the right to inspect the product before returning it to ensure its safety.

3- The consumer has no right to return the product in the following cases:

* If the product was manufactured based on the consumer’s request or according to specifications specified by him, with the exception of products that have a defect or that do not comply with the specifications specified by the consumer.

* If the product is defective due to poor possession by the consumer.

4- If the provisions of the aforementioned return policy are met, the consumer has the right to terminate the contract and return the product to Zad Gulf Company with a refund of the amount paid, noting that the refund is through the bank and takes a period of fifteen to twenty-five working days.

Article Sixteen - Applicable law or regulation:

This User Agreement is governed by and formulated in accordance with the laws, regulations and legislation in force and in effect in the Kingdom of Saudi Arabia, and is fully and completely subject to the regulations in force with the authorities in the Kingdom of Saudi Arabia.

Article Seventeen - General Provisions:

* In the event that any provision or clause contained in this User Agreement is cancelled or that any provision or clause contained in this User Agreement is no longer valid, such matter shall not cancel the validity of the remaining provisions, clauses and terms contained in this User Agreement and they shall remain valid until further notice from the management of Zad Gulf Trading Establishment.

* This User Agreement - which may be amended from time to time as appropriate - constitutes the User Agreement, working mechanism, understanding, agreement and contract between Zad Gulf Trading Establishment and the user. Both parties to this agreement agree to take into consideration the following:

1- The Arabic language is the language used when interpreting the provisions of this agreement, or when translating it into another language.

2- All prices displayed for the services or products of Zad Gulf Trading Establishment may be modified from time to time.

3- The promotional or marketing offers that may be placed by Zad Gulf Trading Establishment are temporary offers, as Zad Gulf Trading Establishment has the right to modify or stop these promotional or marketing offers at any time.

4- The parties to this agreement are committed to dealing with each other in a manner that does not violate the Sharia rules, regulations and laws in force related to the nature of the dealings between Zad Gulf Trading Establishment and the user.

5- This User Agreement shall not be cancelled except by a decision issued by the management of Zad Gulf Carpentry Establishment.
